Moral turpitude is a legal concept in the United States referring to behaviors that violate generally understood, but unspoken community standards of justice, honesty or good morals. Crimes of moral turpitude shock the public conscience and usually involve base, vile or depraved conduct.

The definition of “crimes of moral turpitude” is nebulous and subjective. Texas courts and attorneys arguing before the Board of Immigration Appeals (BIA) have wrangled about its definition and how it is to be applied to the specific case before the court.  What the courts or the Board want to know is whether someone knowingly and intentionally used deception for their own end or hurt another.  If so, the action shows evil intent and implies bad character on part of the offender.

In Texas, a crime of moral turpitude is considered to be an act that is knowingly contrary to honest, just behavior.  In everyday language, these are acts of dishonesty, fraud, deceit, misrepresentation, or theft.

Any form of theft crime or of an sexual nature is considered a crime of moral turpitude. A good barometer for deciding on whether or not an act is immoral or not is to consider if you would teach your kids to commit such acts. If fact, if you wouldn’t hire someone with certain crimes of their records it might be a crime of moral turpitude.

A person convicted of selling drugs won’t have too much trouble getting hired at certain companies that are looking for money motivated individuals. The decision makers at those same companies would probably scoff and the idea of having a child molester or thief in their midst.
