DWI Offenses & The State of Texas
DWI offenses are big business for the State of Texas. Upon conviction of DWI, state surcharges start at $1,000 a year for three years to maintain your privilege to drive. If you are convicted of DWI with a blood alcohol content of .15 or more the three-year surcharge is $1,500 a year.

- When law enforcement says, “Step over here so I can check your eyes, to make sure you’re okay to drive,” respectfully decline.
- When law enforcement says, “I need you to blow into this so I can make sure you’re okay to drive,” respectfully decline.

DWI: Driving While Intoxicated
Driving While Intoxicated (DWI) is the crime of operating a motored vehicle on public roads while intoxicated by alcohol or any legal or illegal intoxicating substance that affects a person’s mental or physical faculties to drive.
DUI: Driving Under the Influence
Driving Under the Influence (DUI) is the criminal charge for persons under 21 years of age driving while intoxicated by alcohol or any legal or illegal intoxicating substance that affects a person’s mental or physical faculties to drive. If a person is under 21 years of age, .08 does not come into play. Any amount of intoxicating substance is considered against the law.
The burden is solely on the State of Texas to prove in a court of law that, not only did you ingest a intoxicating substance, but that the level of intoxication impaired either your physical or mental ability to drive.
