Experienced Texas DWI Lawyer
Were you accused of Driving While Intoxicated (DWI) on alcohol or while under the influence of another substance? The Law Office of Sandra J. Oballe can help you fight prosecution and defend your good name. If you need my help, don’t hesitate to schedule a 100% confidential consultation regarding your case with me.
As a DWI defense lawyer in Brazoria County, Angleton, and Houston for 14 years I can tell you from experience that patrol officers and especially DWI task force officers aggressively look for drunk drivers on a daily basis.
Many of these arrests result in defendants being found not guilty or having their cases dismissed due to inaccurate or lost evidence or a unjust arrest. If you or someone you love is entangled in the Texas criminal justice system due to allegations of DWI, I can help you.
DWI Offenses & The State of Texas
DWI offenses are big business for the State of Texas. Upon conviction of DWI, state surcharges start at $1,000 a year for three years to maintain your privilege to drive. If you are convicted of DWI with a blood alcohol content of .15 or more the three-year surcharge is $1,500 a year.
DWI Task Force
DWI Task Force is always on patrol in Texas. They are more active on weekends, holidays, and days surrounding special events in Brazoria County, Harris County, and on the many interstate highways that traverse the State of Texas. These officers are particularly patrolling for the purpose of spotting drivers who exhibit signs of driving while intoxicated (DWI).
Pulled Over, Stopped & Detained?
Preferred Conduct When Engaging Law Enforcement
- On the roadside be polite to officers.
- Remember, you are being recorded.
- DO NOT volunteer to blow into the PBT (portable breath tester) on the roadside.
- DO NOT volunteer to blow into the breathalyzer at the station.
- DO NOT volunteer to provide a blood sample.
- Refuse ALL tests.
- When law enforcement says, “Step over here so I can check your eyes, to make sure you’re okay to drive,” respectfully decline.
- When law enforcement says, “I need you to blow into this so I can make sure you’re okay to drive,” respectfully decline.
DWI & DUI; What’s The Difference?
DWI: Driving While Intoxicated
Driving While Intoxicated (DWI) is the crime of operating a motored vehicle on public roads while intoxicated by alcohol or any legal or illegal intoxicating substance that affects a person’s mental or physical faculties to drive.
DUI: Driving Under the Influence
Driving Under the Influence (DUI) is the criminal charge for persons under 21 years of age driving while intoxicated by alcohol or any legal or illegal intoxicating substance that affects a person’s mental or physical faculties to drive. If a person is under 21 years of age, .08 does not come into play. Any amount of intoxicating substance is considered against the law.
The burden is solely on the State of Texas to prove in a court of law that, not only did you ingest a intoxicating substance, but that the level of intoxication impaired either your physical or mental ability to drive.
Texas Drivers Have Rights
Most law enforcement officers will not inform you of your right to refuse roadside field sobriety tests. You absolutely have a right to refuse.
Getting pulled over by law enforcement for any reason can be stressful. Realizing that you’re being pulled over for DWI can be alarming. It may be late. You may be tired. You may have been texting.
