A General Overview of Sexual Assault
- The Texas Penal Code defines assault as an offense against the person.
- Sexual assault is an assaultive offense of a sexual nature.
Sexual assault is generally defined as the unwanted or non-consensual contact with body parts that may be considered sexual or for sexual arousal on part of the offender. The law discusses a number of examples which include the penetration of sexual organs or the exhibition of one’s own sexual organs for sexual arousal. Sexual assault may also be defined as causing another person to touch the sexual organs of the offender.
Unintentionally brushing against a young woman’s breast could be grounds for a sexual assault claim, depending on how she feels about it.
Post-Conviction Criminal Penalties
For individuals convicted of sexual assault, the stakes are high. Depending on the nature of the incident, prosecutors could seek either First or Second Degree Felony charges.
Cases in which prosecutors seek First Degree Felony criminal classification involve victims who can’t be reasonably expected to defend themselves or that the offender would not be allowed to marry.
- Second Degree Felony sexual assault convictions carry a prison sentence ranging from 2-to-20 years with a fine of up $10,000.00 and the dreaded Sex Offender Registration requirement.
- First Degree Felony sexual assault convictions carry a prison sentence ranging from 5-to-99 years with a fine of up to $10,000.00 and the dreaded Sex Offender Registration requirement.
