Understanding Child Molestation Cases
A person can be charged with indecency with a child as the result of any number of actions involving an adult and a child. In most cases, persons are charged with indecency with a child following allegations of fondling, touching or exposing the genitals of the child or that of the adult’s, and direct sexual assault of a child. Usually in cases of child sexual assault the case is classified as aggravated sexual assault as opposed to indecency. Below we’ve outlined both types of indecency with a child offenses.
Indecency with a Child by Exposure
If an individual is accused of exposing their genitals in the presence of a minor or causing a child to expose their genitals, the individual will face criminal charges for a felony of the third degree. If convicted, it can mean a prison sentence of two to ten years, a fine of up to $10,000.00 and a sex offender registration requirement.
Indecency with a Child by Sexual Contact
Second-degree felony charges will apply to persons charged with indecency with a child by sexual contact. The crime is different from exposure as actual physical contact is alleged. If convicted of child molestation, the defendant will face a prison sentence of 2-to-20 years, a fine of up to $10,000.00, and will be required to register as a sex offender upon their release.
