Surviving Arrest: A Helpful Guide for Texans

Less than 1 minute Reading Time: Minutes

Getting arrested can be a scary experience, especially for people going through the situation for the first time. It’s normal to feel overwhelmed during the arrest and afterwards. However, you can come out of the situation in a positive fashion.

Another thing to know is that you don’t have to deal with the situation on your own. As experienced criminal defense lawyers, we’re here to walk you through the process.

If you have any questions or need to talk with a defense lawyer about a criminal charge in Brazoria County or Harris County, contact the Law Office of Sandra J. Oballe today at 713-524-6656 or 979-265-6800. Our law office has locations in both Houston & Angleton. We provide excellent financial options and 100% confidential attorney-client consultations.

Step 1: Stay Calm and Composed

First and foremost, stay calm. It’s natural to feel anxious during an arrest. But remember, your actions will be closely observed. If you demonstrate poor behavior, it can be used against you in court. Even if you believe your arrest is not justified, remain silent and DO NOT resist arrest.

Step 2: Invoke Your Right to Remain Silent

The moment you’re arrested in Texas, your Miranda rights kick in. You’ve probably heard the phrase “You have the right to remain silent” on TV shows.

Well, it’s more than just a line. It’s a fundamental right designed to protect you. Use it.

Anything you say to police officers can be used against you in court. Politely inform the arresting officer that you choose to exercise this right. Don’t talk about your case on those county jail phones either. Those phone calls are recorded and will be used against you should any damning statements be made.

Step 3: Request an Attorney

As soon as you can, ask to speak with a criminal defense attorney. It’s your right under the Constitution of the United States to have legal representation. We don’t recommend that you answer any questions or engage in any conversations with law enforcement until your attorney is present.

Remember, keeping quiet is not an admission of guilt, it’s a smart move that helps you to protect your rights. If you’re not interested in helping the state to put you jail, remain silent.

Step 4: Don’t Consent to Searches

Unless they have a valid search warrant or probable cause, police cannot search your property without your consent. Don’t voluntarily agree to a search. Politely refuse any requests to search your car, house, or person. You’re protected against unlawful searches & seizures by the Fourth Amendment to the Constitution of the United States. Take full advantage of your rights.

Step 5: Stay Respectful, But Assertive

Even as you exercise your rights, be respectful to law enforcement. Being combative or disrespectful could escalate the situation. If the situation escalates, you’ll be on the bad end of the deal. At the same time, be firm when asserting your rights.

If you’re unsure about how to handle the situation, remember this phrase: “I wish to remain silent, and I want to speak with my attorney.”

Step 6: Keep Track of the Details

In the confusion of an arrest, it’s easy to forget minor details that could be important later on. Try to remember names, badge numbers, patrol car numbers, and the agency of the officers involved. Keep a mental note of the sequence of events.

Sometimes, writing a summary of the details is the best way to ensure that you don’t forget the nuances of the occurrence. Writing the details of the incident can also be helpful to your attorney. If you’re working with our law firm on your case, we’ll want a detailed account of events from your perspective.

Step 7: Contact a Trusted Individual

As soon as you can, inform a friend or family member about your situation. They can start the process of securing your release and contact a criminal defense attorney on your behalf.

It’s much easier to fight your charge in the freeworld as opposed to trying to fight your case from behind bars. If you have trouble getting yourself or a family member out of jail during the pre-trial phase of your case, contact the Law Office of Sandra J. Oballe today.

Step 8: Engage a Criminal Defense Lawyer

Consulting with an experienced criminal defense lawyer is the most crucial step after an arrest. A qualified defense attorney will guide you through the legal maze, affirm your rights, and craft an effective defense strategy for your situation.

Most people think they can’t afford a defense attorney. The Law Office of Sandra J. Oballe provides affordable legal fees, flexible payment options, and excellent legal representation. If you have questions about how we can help you, contact us today.

Step 9: Comply with Bond Conditions

If you’re released on bond, comply with all conditions set by the court. Bond conditions could include avoiding certain people, places, and abstaining from alcohol or drug use. Another condition of your bond will be to attend all court appearances. If you miss court, a warrant will be issued for your arrest.

Failure to comply with your bond conditions could result in your bond being revoked. If this occurs, it means you’ll be jailed by law enforcement at their first opportunity to detain you. Violating the terms of your bond will create unnecessary complications for your case.

Step 10: Participate in Your Defense

Once you’ve hired an attorney, work closely with them to build your defense. Provide all the relevant information your lawyer will need. Be sure to stay involved in your case and follow your attorney’s advice to the letter. The worst thing that could happen is something happens that hurts your case.

Remember, police arresting & detaining you isn’t the end of the world. It’s a tough experience, but it’s only temporary. With the right lawyer on your side, you can handle the originating criminal charges with no problems. You’re not alone – we’re here to help.
